1. Overview
Jenni Gilroy - JKG Photography (“we,” “us,” or “our”) provides photography services including portrait sessions, family sessions, senior portraits, sports coverage, events, and digital image delivery. By booking a session, accessing our website, or purchasing any services, you agree to these Terms of Service.
2. Booking & Payment
• A non‑refundable retainer is required to secure your session date.
• Remaining balances are due as outlined in your invoice or contract.
• Session dates are not held without a retainer and signed agreement.
• Prices are subject to change at any time, but confirmed bookings are honored at the contracted rate.
3. Cancellations & Rescheduling
• Retainers are non‑refundable but may be transferred to a new date if rescheduled within the timeframe stated in your contract.
• Weather reschedules are at the photographer’s discretion.
• For events or sports coverage, cancellations within 48 hours may be subject to additional fees.
4. Image Delivery
• Final images are delivered through a secure online gallery (Pixieset).
• Turnaround times vary by session type and are outlined in your contract.
• Galleries remain active for a limited time; clients are responsible for downloading and backing up their images.
5. Editing & Retouching
• All delivered images are professionally edited in the photographer’s signature style.
• Additional retouching requests (skin smoothing, object removal, composites, etc.) may incur extra fees.
• RAW/unedited files are never released.
6. Copyright & Usage
• Jenni Gilroy - JKG Photography retains full copyright to all images.
• Clients receive a personal-use license for printing, sharing, and downloading.
• Images may not be altered with filters, AI edits, or third‑party enhancements without permission.
• Commercial use requires a separate licensing agreement.
7. Photographer Usage Rights
• We may use images for portfolio, website, social media, marketing, and promotional purposes unless the client submits a written request opting out prior to the session.
• For minors, usage follows the terms agreed upon by the parent/guardian.
8. Client Responsibilities
• Clients agree to arrive on time, prepared, and with any requested items (outfits, props, uniforms, etc.).
• For sports and events, clients are responsible for securing necessary permissions or access if required.
• The photographer is not liable for missed shots due to restrictions, venue rules, or interference.
9. Liability
• We are not responsible for injuries, accidents, or property damage during sessions.
• In the rare event of equipment failure, illness, or unforeseen circumstances, liability is limited to rescheduling or refunding the session fee.
10. Digital Files & Archiving
• Delivered images should be downloaded and backed up promptly.
• We do not guarantee long‑term archiving of galleries after the stated expiration date.
11. Refunds
• Due to the custom nature of photography, all sales are final.
• Refunds are only issued if the photographer cancels and no reschedule is possible.
12. Website Use
• All content on this website—including images, text, branding, and graphics—is owned by Jenni Gilroy - JKG Photography and may not be copied or reproduced without permission.
• Unauthorized use of images is strictly prohibited.
